Davar Communities — Member Terms of Service

Welcome to Davar Communities. You're here because someone you trust built a community worth joining, and we're glad you came. These terms explain the simple stuff: how your account works, how billing works, what we can see (and what we can't), and how to leave if you ever want to. 1. Who this is between
These Member Terms of Service (the "Terms") are an agreement between you and Solomon Websites Inc., a corporation incorporated in the Province of Alberta, Canada ("Davar Communities," "we," "us," or "our"), which operates the Davar Communities platform (the "Service"). By creating an account or using the Service, you agree to these Terms. These Terms replace any prior Solomon Websites Inc. Terms of Service.
2. Account vs. Community
Two words matter here:
- Your "Account" is your free identity on Davar Communities — the login you create to use the Service.
- A "Community" is the paid space a Leader creates and runs. You can have a free Account and join paid Communities separately.
Joining or paying for a Community is separate from creating your Account.
3. Eligibility
You must be at least 18 years old to use the Service. See Section 13 (Children's data) for related details. You agree to provide accurate, complete, and current information.
4. Solomon Websites Inc. is the Merchant of Record
When you subscribe to a Community, you are purchasing from Solomon Websites Inc. (operating as Davar Communities), not directly from the Leader. Solomon Websites Inc. is the Merchant of Record: the charge on your statement comes from Davar Communities, your receipt comes from Davar Communities, and any payment dispute runs through Davar Communities. Solomon Websites Inc. pays the Leader from those subscription payments.
5. Pricing and billing
- A Community is either free or paid, as set by its Leader.
- There is no member trial.
- All prices are in US Dollars (USD). If your card is in another currency, your card network sets the exchange rate (FX).
- Your subscription renews automatically at the start of each period until you cancel.
6. Cancellation is not the same as a refund
You can cancel any time from your account settings — it's always self-serve, and we don't use dark patterns (no guilt-trip screens, no fake urgency, no hidden buttons, no "are you sure?" mazes). Here's how cancellation works:
- Cancelling stops the next renewal. Your subscription ends at the end of the period you've already paid for.
- Your access continues through the rest of that paid period.
- Cancelling does not return any money. No money is refunded simply because you cancel.
Refunds are a separate thing — see Section 7.
7. Refunds
Refunds are handled by your Community Leader, not by Davar Communities. If you'd like a refund, contact your Leader by direct message or email. The Leader decides whether to issue a full or partial refund. The full rules are in our Refund Policy at /legal/refunds.
8. What your Leader can see (activity transparency)
Davar Communities uses two tiers of activity visibility, and you should know the difference:
- Tier 1 — Personal activity tracking. This is your individual usage data (for example, what you view and when). You can opt out, and we respect that opt-out.
- Tier 2 — Public social actions. These are the things you do publicly in a community — public posts, "Thank-yous," "Amens," and similar visible actions, shown in aggregate. These are not opt-outable, because they're public by nature.

9. Community Guidelines and moderation
Your conduct in a community is governed by the Community Guidelines, which are the operative conduct code and are incorporated into these Terms by reference.
A few honest notes on moderation:
- Every flag gets reviewed.
- There is no formal appeal flow. If you believe something was handled in error, email support@davarcommunities.com.
10. Account security and accuracy
You are responsible for safeguarding your login and for all activity under your account. Keep your information accurate and current, and notify us immediately at support@davarcommunities.com if you become aware of any breach of security or unauthorized use of your account.
11. Intellectual property and your content
The Service and its original content, features, and functionality are and remain the exclusive property of Solomon Websites Inc. and its licensors.
You keep ownership of the content you post. By posting content to the Service, you grant Davar Communities a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely to operate and provide the Service (for example, showing your post to others in the same community). This license ends when your content is deleted, except for copies kept in backups or as required by law.
12. Third-party links
The Service may contain links to websites or services that Davar Communities does not own or control. Davar Communities is not responsible for the content, privacy practices, or conduct of any third-party site, and we encourage you to review their terms and privacy policies.
13. Children's data
The Service is intended for adults. The minimum age to use the Service is 18. We do not knowingly collect personal information from anyone under the minimum age. If we learn that we have, we will delete it. See the Privacy Policy at /legal/privacy for how we handle children's data and COPPA.
14. Warranty disclaimer
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Davar Communities does not warrant that the Service will be uninterrupted, secure, or error-free. You use the Service at your own risk. Davar Communities does not control and is not responsible for the conduct, content, or offerings of any Leader or community.
15. Limitation of liability
To the maximum extent permitted by law, Davar Communities (Solomon Websites Inc.) and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to these Terms or your use of the Service. our total aggregate liability for any claim will not exceed the greater of (a) the amount you paid Davar Communities in the three months before the event giving rise to the claim, or (b) USD $100.
16. Indemnification
You agree to defend, indemnify, and hold harmless Davar Communities and its directors, officers, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, your breach of these Terms or the Community Guidelines, or your violation of any law or third-party rights.
17. Termination
Davar Communities may suspend or terminate your access to the Service for any breach of these Terms or the Community Guidelines, or as otherwise permitted by law. You may stop using the Service and close your account at any time. Provisions that by their nature should survive termination — including ownership, warranty disclaimers, limitation of liability, and indemnification — survive.
18. Dispute resolution, governing law, and class-action waiver
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. The parties will first try to resolve any dispute informally via support@davarcommunities.com. If unresolved within 30 days, the dispute will be finally resolved by binding arbitration in Alberta, Canada, conducted in English under applicable Alberta arbitration rules, except that either party may bring an individual claim in small-claims court. Class-action waiver: to the maximum extent permitted by law, disputes may be brought only in an individual capacity, not as part of any class, collective, or representative proceeding.
19. Force majeure
Davar Communities is not liable for any failure or delay caused by events beyond its reasonable control, including acts of God, natural disasters, war, civil unrest, governmental action, pandemics, power outages, or failures of the internet or third-party service providers (including our payment processor and our email, storage, hosting, and infrastructure providers).
20. Changes to these Terms
We may modify these Terms from time to time. If a change is material, we will provide at least 30 days' notice before it takes effect, by email or in-Service notice. By continuing to use the Service after a change takes effect, you agree to the revised Terms. If you don't agree, please stop using the Service.
21. Assignment
You may not assign these Terms. Davar Communities may assign them, including in connection with a merger, acquisition, or sale of assets.
22. Severability and entire agreement
If any provision is held invalid or unenforceable, it will be limited or severed and the rest will remain in effect. These Terms, together with the Community Guidelines, Refund Policy, and Privacy Policy, are the entire agreement between you and Davar Communities regarding the Service and supersede all prior agreements, including any prior Solomon Websites Inc. Terms of Service. Our failure to enforce any provision is not a waiver of it.
